Welcome to Clickd! These Terms of Service (“Terms”) govern your use of our website, application, and services (collectively, the “Service”). By accessing or using Clickd, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, do not access or use the Service.

1. Eligibility

Clickd is intended only for individuals who are 18 years of age or older. By using the Service, you represent and warrant that:

  • You are at least 18 years old;

  • You have the legal capacity to enter into a binding agreement;

  • You are not prohibited by law from using dating or matchmaking services.

2. Beta Disclaimer

Clickd is currently in beta testing. Features, functionality, and user experience are subject to change. We may modify, suspend, or discontinue the Service or portions of it at any time without notice.

By joining the beta, you acknowledge that:

  • The Service may have bugs or limited functionality.

  • Data and preferences submitted may be used to improve our AI matchmaking engine.

3. Account Registration

To access certain features, you may be required to:

  • Provide accurate, complete information

  • Maintain the confidentiality of your account login

  • Agree not to impersonate others or misrepresent information

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Conduct

You agree to use Clickd responsibly and in a manner consistent with applicable laws. You may not:

  • Harass, threaten, or abuse other users

  • Post offensive, pornographic, or misleading content

  • Use bots, automation, or scraping tools

  • Upload viruses, spam, or anything malicious

  • Attempt to gain unauthorized access to any part of the Service

We reserve the right to remove content or restrict access to users who violate our guidelines.

5. User Content & License

You retain ownership of the content you submit (e.g., photos, bios, messages). However, by submitting content to Clickd, you grant us a non-exclusive, worldwide, royalty-free license to use, host, display, and process it for the purpose of operating and improving the Service.

6. Intellectual Property

All intellectual property related to Clickd — including logos, branding, software, AI models, and design — is owned by Clickd or its licensors and protected by copyright and trademark laws. You may not reproduce, distribute, or modify any part of the Service without our prior written consent.

7. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using Clickd, you consent to our data practices.

8. Third-Party Links & Services

The Service may include links to third-party websites or services. Clickd is not responsible for the availability or content of those services, and use of third-party services is at your own risk and subject to their own terms and privacy policies.

9. Disclaimer of Warranties

Clickd is provided “as is” and “as available.” We do not guarantee:

  • That matches will be accurate or relationships will result

  • Continuous, secure, or error-free access to the Service

  • That any user-generated content will be true or appropriate

We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, Clickd shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of (or inability to use) the Service.

This includes loss of profits, loss of data, or emotional distress, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless Clickd, its officers, directors, employees, and agents from any claims, damages, or losses arising out of:

  • Your use of the Service

  • Violation of these Terms

  • Violation of any applicable law or rights of a third party

12. Termination

We may terminate or suspend your account at any time, with or without notice, if:

  • You breach these Terms

  • We suspect harmful or fraudulent activity

  • We discontinue the Service

Upon termination, your right to access the Service will immediately cease.

13. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to its conflict of law principles. Any legal action must be brought in the courts of King County, Washington.

14. Dispute Resolution & Arbitration

Where allowed by law, any disputes shall be resolved through binding arbitration rather than in court. By agreeing to these Terms, you waive your right to a jury trial or to participate in a class action.

The arbitration shall take place in Seattle, Washington, under the rules of the American Arbitration Association (AAA), and you and Clickd agree to submit to the personal jurisdiction of such proceedings.

15. Modifications to Terms

We may update these Terms from time to time. If changes are material, we’ll notify users via email or through the Service. Continued use after the update constitutes acceptance of the new Terms.
